General conditions of purchase

The terms of purchase are an integral part of the Purchase Agreement between the company Fortuna d.o.o. and the customer.

Payment methods

Payment via internet banking or money order to our giro account IBAN:

Products in the online store can be paid for with the following credit cards: Visa, Master Card, Diners and Maestro, one time.

Basic data

In terms of these terms of purchase, the customer is a natural person who orders or pays for the product delivery service through the website antikvarijat-biblos.hr (hereinafter: web shop, Antikvarijat Biblos or the seller).

Any person who orders at least one book, fills in the required information and pays for the ordered book is considered a customer. The recipient is considered the person to whom the product is delivered, and is different from the person of the buyer.

Seller/ trade intermediary/ service provider

The seller/intermediary in the trade and provider of services is: Fortuna d.o.o., with headquarters at Palmotićeva 28, 10000 Zagreb, OIB: 86828835656, IBAN: HR 3123600001101595832 (hereinafter referred to as the Seller).

Business ability

By accepting the Terms of Business, the Buyer declares that all the information he has provided about himself is true and complete, that he is capable of doing business, and that there are no known obstacles to ordering and purchasing products from the Seller, i.e. for purchasing via the webshop.

Electronic communication

By visiting and using Antikvarijat Biblos web shop, you accept communication via electronic means. You hereby accept that all agreements, notices, announcements and other content delivered to you electronically meet the legal framework as if they were made in written form.

If the visitor or user does not have an e-mail address or enters an incorrect one or cannot receive e-mail due to technical reasons, the seller is not obliged to try to inform the user in any other way about the order itself, nor about any other details related to the order, delivery, payment, refund, complaint and the like.

Prices

All prices displayed in the web shop are expressed in Euros, for the end customer, including VAT and delivery costs for the territory of the Republic of Croatia.

Postage for abroad is charged according to the price list of Hrvatske pošte.

Order and moment of conclusion of contract

Books are ordered by selecting, using the menu and filling out the electronic form. The book is considered ordered when the customer goes through the entire ordering process, i.e. pays for the ordered product.

Payment for ordered products can be made in the following ways:

  • E-banking or general payment slip/virman (payment details: Fortuna d.o.o., Palmotićeva 28, 10000 Zagreb, IBAN: HR3123600001101595832)
  • cards online (Visa, MasterCard, Maestro, Diners)

The order is considered received:

  • In case of payment by credit card - at the moment when Fortuna d.o.o. receives confirmation of pre-authorization of the customer's credit card for the amount of the order
  • In case of payment by e-banking and general payment - at the moment when Fortuna d.o.o. receive the order
  • electronically
  • At the moment when the order is received, the seller will notify the customer via electronic means in the form of e-mail that the order has been received or that the product has been ordered.
  • In the case of payment by credit card, the contract is considered concluded at the moment when Fortuna d.o.o. receives confirmation of pre-authorization of the customer's card for the amount of the order.

After confirming the pre-authorization, Fortuna d.o.o. will notify the customer electronically in the form of an e-mail that he has purchased the book and that it has been sent.

In the case of payment by e-banking and general payment, the contract is considered concluded at the moment when Fortuna d.o.o. receives confirmation that the order amount has been paid.

If the book is ordered, and e-banking or general payment is chosen as the payment method, Fortuna d.o.o. undertakes to reserve the book for 3 working days, not including Saturday and Sunday. After 2 working days from the receipt of the order, Fortuna d.o.o. does not guarantee the availability of the book.

If the ordered book is not available, the seller will inform the buyer that the book is currently unavailable and the deadline for its delivery.

The ordered book, depending on whether it is available, is delivered by the seller as soon as possible.

Payment Security Statement

When paying on our web store, use CorvusPay - an advanced system for securely accepting payment cards via the Internet.

CorvusPay ensures the complete secrecy of your card data from the moment you enter it in the CorvusPay payment form. Payment data is transmitted encrypted from your web browser to the bank that issued your card. Our store never comes into contact with complete information about your payment card. Also, the data is inaccessible even to employees of the CorvusPay system. The isolated core independently transfers and manages sensitive data, keeping it completely secure.

The form for entering payment data is secured with an SSL transport code of the highest reliability. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. CorvusPay meets all the requirements related to the security of online payments prescribed by the leading card brands, that is, it operates in accordance with the norm - PCI DSS Level 1 - the highest security standard of the payment card industry. When paying with cards included in the 3-D Secure program, your bank, in addition to the validity of the card itself, also confirms your identity using a token or password.

Corvus Info considers all collected information as bank secret and treats it accordingly. The information is used exclusively for the purposes for which it is intended. Your sensitive data is completely safe, and its privacy is guaranteed by the most modern protection mechanisms. Only the data necessary for the performance of work are collected in accordance with the prescribed demanding procedures for online payment.

Security controls and operational procedures applied to our infrastructure ensure the current reliability of the CorvusPay system. In addition, by maintaining strict access control, regular security monitoring and in-depth checks to prevent network vulnerabilities, and planned implementation of provisions on information security, they permanently maintain and improve the level of system security by protecting your card data.

Delivery by delivery service and costs

Ordered items are sent by Croatian Post. The price of delivery is 5 euros, regardless of weight, and the territory of the Republic of Croatia. An additional fee of 1 euro for delivery by cash on delivery.

For orders of a total amount greater than 70 Eur, DELIVERY IS FREE for the territory of the Republic of Croatia.

Delivery prices are shown with VAT included.

If the customer is not at the delivery address when the delivery is attempted, the delivery service will leave a notification with the shipment number and instructions for further steps.

Fortuna d.o.o. reserves the right not to send orders with incorrect/incomplete contact data, as well as orders with e-mails/phone numbers that no one answers.

Transfer of ownership and customer obligations

The transfer of ownership of the ordered goods occurs at the moment of handing over the shipment to the delivery service.

Fortuna d.o.o. is not responsible in the event that the customer did not enter the delivery address correctly, and for this reason the package did not reach its destination. Fortuna d.o.o. is not responsible if you did not receive a notification about the change in the status of the order/sending the shipment due to the settings of your e-mail service.

In the event that you are not present at the delivery address, it is your responsibility to pick up the package at the branch office of the delivery service within the time period determined by the delivery service, or arrange a new delivery if the engaged delivery service allows such a choice.

If the package does not arrive within 4 working days of receiving notification that the package has been shipped, it is your duty to contact the engaged delivery service and check where the package is.

It is the Buyer's duty to provide information about the delivery address and any additional details related to delivery (for example, additional descriptions of the delivery address if the destination is not completely clear from the address). In the absence of such information, the Seller will organize the delivery of the goods in the best way, but then does not accept any responsibility regarding the delivery time and delivery risks.

Material defects of the product

Fortuna d.o.o. is responsible for the material defects of the products it sells on its website in accordance with the positive regulations of the Republic of Croatia, especially the Obligations Act.

Ordered books are packed in such a way that they are not damaged by normal handling during transport/delivery.

Complaints and returns

The customer has the right to a justified complaint and to return the goods in case of:

Delivery of goods that were not ordered

The deadline for submitting a complaint is 8 days from the receipt of the package.

In the case of a request for the return of goods for justified reasons, the buyer is obliged to send a written complaint to the Seller by e-mail to info@antikvarijat-biblos.hr or by registered mail to the address: Fortuna d.o.o., Palmotićeva 28, 10000 Zagreb.

In order to determine as quickly as possible the specific order to which the customer has an objection, customers are asked to state the order number or invoice number in the objection. Fortuna d.o.o. will confirm the receipt of the complaint in writing without delay, and the response according to Article 10.5. of the Law on Consumer Protection must arrive within 15 (fifteen) days from the day the complaint was received.

In the event of a justified complaint, the customer has the right to terminate the contract with a refund of the amount paid or exchange for an undamaged and valid product.

Written consumer complaint

In case you are dissatisfied for any reason, you can send a complaint to Fortuna d.o.o.  which enables submission of a written complaint by registered mail to the address Fortuna d.o.o., Palmotićeva 28, 10000 Zagreb or via email info@antikvarijat-biblos.hr

In order to determine the specific order against which you have a complaint as quickly as possible, state the order number or invoice number in the complaint. Fortuna d.o.o. will confirm the receipt of the complaint in writing without delay, and according to the law, the answer must reach you within 15 (fifteen) days from the day the complaint was received.

Online dispute resolution

By special regulation of the European Union, dated February 15, 2016. throughout the EU, disputes related to online purchases will be resolved through the ODR platform, which you can access here.

This means that if you encounter a problem during an online purchase within the EU (defective product, inability to exchange a product, etc.), you can submit your complaint in a faster and simpler way at the link above.

The platform can be used by both consumers and traders, and complaints can be submitted in any of the 23 official languages of the EU.

Product information

Book photos are illustrative in nature and do not always have to correspond in all details to the products that are the subject of the order. The seller especially points out that the visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality, especially with regard to the monitor settings on the customer's computer, differences in the perception of colors as the customer sees them on the screen, etc.

In the case of the above discrepancy between the product shown in the photo and the delivered product, it is not a product defect.

Product data (product description, price, etc.) displayed on the seller's web shop are subject to bugs, irregularities in the operation of the application, other technical irregularities, typographical errors, etc. In case of obvious errors or malfunctions with regard to product data displayed on the web shop, the seller reserves the right to unilaterally terminate the contract.

Data privacy

On behalf of Antiquariat Biblos Web Shop, we undertake to protect the privacy of all our customers. We only collect necessary, basic data about customers/users and inform customers about how to use them.

All user data is strictly protected and is only available to employees who need this data to perform their work. All employees of Antikvarijat Biblos Web Shop and business partners are responsible for respecting the principles of privacy protection.

Final provisions:

By accepting these conditions of purchase, the customer agrees to the provisions of these conditions and accepts that they form an integral part of the contract.

By confirming the order, the Buyer confirms that he has read the Business Terms and Conditions, that he agrees with them and that they form an integral part of the Purchase Agreement.
