Adolf Julius Merkel: The Double Face of Law

 

Merkel's article The Double Face of Law was first published in the journal "Juristische Blätter" in 1918. In the same year, the author published it as an independent work in Vienna in his own edition. That early article by Merkl is the first of his writings to appear in the Serbian language.

Especially important is his understanding that every legal act contains two elements - the creation of law and the application of law. Thus, for example, a judgment, within the framework previously determined by the law, also creates law and is not just its simple application. This circumstance, which, of course, also applies to the law, gave Merkel the reason to talk about the "Janus face" of the legal act or, what is the same, about the "double face" of law.
