Mirjan Damaška's book Homeland is difficult to place within the framework of classical literary and scientific genres and classifications because it contains numerous autobiographical elements, but thematically it is much broader and much deeper in thought, so in this respect it is closer memoirs or memoirs.
Mirjan Damaška is not a typical criminal law scholar, but a real philosopher of law who is very close to existential philosophy, philosophy and sociology of morality, and moral theology. 
In his memoir of memory Homeland, he selflessly and courageously shares with the reader his own memories, reminiscences, moral trials, desires and sufferings, fears, anxieties, but also happy digressions about the time, people and events that accompanied and shaped his rich professional and self-effacing family emotional life.

After the collapse of the Croatian Spring, Mirjan Damaška leaves for the United States of America and in legal sciences he finds a substitute for his lost homeland and homeland. But leaving the homeland for Mirjan Damaska does not mean forgetting the homeland.
Moreover, the key motive for writing the study The Shadow Side of Command Responsibility, published in »The American Journal of Comparative Law«, was the draconian (forty-five-year) prison sentence handed down by the Hague Court to war general Tihomir Blaškić due to individual and command responsibility.

About the trial against Bosnia and Herzegovina's Six, as well as the consequences of a possible conviction by the Hague Court - in the trial against Generals Ante Gotovina, Ivan Čermak and Mladen Markač, and thus the entire Croatian state leadership led by Franjo Tuđman - had a diametrically opposite point of view from some Croatian politicians. His theoretically based opinion - the conviction and then the acquittal will show - was absolutely correct.

Homeland is the confession of Mirjan Damaška and the story of his very interesting, successful life as a lawyer, scientist, university professor and emigrant believer, whose choice of a narrower specialization - comparative criminal law - was and remains a metaphorical bridge, cognitive and emotional, between two countries, Croatia and America, two continents, two legal traditions, two ways of life, several homes and only one true homeland - Croatia.
